Under Florida law, the public records held across the state of Florida by different repositories are generally subject to disclosure even if they contain sensitive, private, confidential or any other type of information that is exempt from disclosure as defined by law. The custodian of the public records of the sort must simply redact the information that is exempt and disclose the rest of the record to the requester. For example, social security numbers belong to strictly confidential information and therefore should not be disclosed, because they often may lead to the disclosure of a person’s financial, medical or other information of restricted access nature contained in the other records.

If released, such information may result in the loss of privacy and lead to the individual becoming victim of a crime like identity theft, and also possibly putting in jeopardy the other members of that person’s family. Anyway, this exemption doesn’t cover cases of the responsible commercial use of the social security numbers, since it is an established fact that many private businesses use social security numbers for purposes like running a pre-employment or tenant background check as well as resort to checking up the information matching ssn to anticipate or fight the same attempts of fraud or identity theft related offences. Also business often have justifiable need to know ssn’s to be able to quickly verify identity of a person in the process of different kinds of business deals and transactions.

The other type of information that may be on public records are driver’s licenses numbers that are often used for purposes similar to those of ssn’s. In Florida the disclosure of information that is contained in public driving records is regulated based on the known Drivers Privacy Protection Act provisions restricting public access to this type of records, or at least to some parts of them. If you are a private individual you’ll hardly be allowed to view someone else’s driving record without providing a good reason for doing so. Also police records have certain limitations as far as their disclosure is concerned. For example, the information pertinent to a confession contained on a police arrest or detention record would not be disclosed for public inspection until the case is resolved. There are many exemptions covering disclosure of public records in Florida, the concern is they would be applied properly and for the benefit of citizens.
